Well, this is interesting, SEC got sent back to the drawing board. They ofcourse will rebound, when , I dunno. But they will. Basically means that the SEC cant touch and surfs (hedgefunds as they can be classified) unless they have over $30 Million dollars. Surfs dont need to register with SEC until they get to that point. So just another a small step in legitimizing this industry. Dont get me wrong, if a surf is a ponzi it is illegal. Read this article:

WASHINGTON (Reuters) - In a major setback to the U.S.
Securities and Exchange Commission's efforts to regulate the $1.3 trillion hedge fund industry, a federal appeals court on Friday tossed out a rule requiring the investment pools to register with the agency.

The SEC rule, which went into effect in February, was a key first step in regulating an industry, which saw its assets double in the past five years as pension funds, endowments and charities poured in billions of dollars to boost their investment returns.

The court decision raises questions about how aggressively the SEC will seek to regulate the industry. The hedge fund rule was narrowly adopted on a 3-2 vote under SEC Chairman Christopher Cox's predecessor, William Donaldson.

Cox said he directed SEC staff to evaluate the court decision and draft a "set of alternatives" on how the agency should approach the hedge fund industry. "The court's finding ... requires that going forward we reevaluate the agency's approach to hedge fund activity," he said.

But speaking in Washington on Thursday, Cox questioned whether the SEC currently has the ability to register and monitor the fast-growing hedge fund industry, citing a demand on resources.

"If we did that, we'd have to stop doing something else," he told reporters at a conference.

The court ruling opens the door for advisers in the loosely regulated industry to withdraw their SEC registration.

As of Friday, there were 2,533 investment advisers registered with the SEC who managed 13,876 hedge funds with assets totaling $2.4 trillion. Advisers often manage several funds.

"So the court is really sending the SEC back to the drawing board on this, with such fundamental questions raised that I tend to doubt the SEC will even try to redraw the rule," said Peter Blume, a lawyer who specialises in corporate compliance issues.

The rule adopted by the SEC required most U.S. hedge funds with more than $30 million in assets and 15 or more clients to register with the agency. Registration meant submitting to periodic audits, keeping better records and following new procedures aimed at discouraging would-be cheaters.

In a victory for the hedge funds, the U.S. Court of Appeals for the District of Columbia declared the rule arbitrary because it exempted funds with fewer than 15 clients.

"The number of investors in a hedge fund -- the 'clients' according to the commission's rule -- reveals nothing about the scale or scope of the fund's activities," the court said.

"It is the volume of assets under management or the extent of indebtedness of a hedge fund or other such financial metrics that determines a fund's importance to national markets."

The decision was cheered by hedge fund managers.

"It looks like a pretty complete victory," said Phillip Goldstein, who filed the lawsuit challenging the SEC and manages the $220-million New York-based hedge fund group Bull Dog Investors. "The fundamental argument is the SEC does not have the authority to adopt this rule."

Some experts said the ruling might spur the SEC to expand its scope of jurisdiction.

"It's possible that the ruling will result in a review of the asset management business and revisions to the Advisors Act in a way that expands the SEC's mandate to include private equity funds," securities attorney David Goldstein said.

Business advocates said they hoped the decision would prompt the SEC to reconsider rules some view as unnecessary.

"I hope the SEC will start fresh and determine the problem it is trying to solve and then find the most surgical instruments it needs to do that," said
U.S. Chamber of Commerce Senior Vice President David Hirschmann.

Hirschmann said the SEC should first consider other oversight methods such as identifying particularly risky hedge fund activities, or raising the minimum net worth for investors to participate in hedge funds.

The court ruling came the same day the New York Times reported the SEC had investigated Pequot Capital, a $7 billion hedge fund, for possible insider trading. A senior SEC lawyer in the case claimed he was fired after he sought to subpoena a top Wall Street executive in the probe.

Pequot denied any wrongdoing.

Well, after a long struggle with myself, to either stay in the industry or get out, as a member, I have decided to stay. After reviewing my historical data, I am have found that I am in profit.

Plus I like the freedom I get and helping people as much as I can.

Before I continue, I have implemented a "red flag cycle" policy. The first sign of a red flag, I am out of a program. Why? If you look back at all the fallen surfs, they each had some red flag tellin us members "WE ARE HAVING ISSUES, WATCH OUT". Some of us dont know what they are, but some do and continue and then when the site falls, start complaining.

With that said, I have started upgrading in certain programs. One is:

Wow, its been almost 2 weeks or so since my last post. Regarding NME/Phoenix
Surf, I have nothing. They say they are refunding folks not in profit. Period.

Wired Surfs demise hurt a lot of people. Hopefully they will keep their word and refund peoples money.

I am adopting a new method for dealing with surf sites. This method is the cycle method. I wil lbe upgrading in a cycle by cycle basis. Once I see one sign of a red flaf, I am pulling out of it ASAP.

Well, I am on vacation still, so I will try to post more later on.

Yesterday was a great day for our program. As you will see this morning the Automatic Upgrades for the members due payouts are in place and the Phoenix program is back to functioning as designed. The meeting in Mississippi was a huge success. Alright, let’s take some time to talk about some updates:

1. Members can once again register for the NME debit card using Paypal by going to www.nmecard.com. Please take the time to place your order if you have not already done so!
2. Integration: The call functions are working great between our system and VMs. What does this mean? The integration process is working now we are adding the layers of security necessary to protect our members and their funds. As soon as we are 110% confident that the security is maximized, we will make the debit card payment option available to our members!
3. Payouts are continuing well. Please remember, cashouts for this week might be 24-48 hrs beyond the 7 business day time frame. Easy an cheap way to Fund NME Card, in my opinion

With the new NME Cards on the market, I have been trying to figure out what the easiest way to fund your new card is. Well, I have 2 suggestions. But first, there are multiple options, such wires, i person deposits. Those options requir eyou to contact Virtual Money to make sure they credit your account. I dont like that idea.

My favorite way to fund the card is via Paypalm followed by card to card option.

Fund the Your NME Card via PayPal
I did this myself. Easy, I added the card as a bank account. Then verified it. After that I simply withdrew funds to the nme card and in a couple of days it was done. No extra fees or pain in the butt processing.

You set up your Debit Card the same as you would add a new Bank Account. Your NME Card has a routing number and account number, you can move funds from PayPal to the card the same way you would move money to a checking account. Use the Virtual Money Routing number: 111900756. Your Account Number would be: 8+ the last 9 digits of your card number. Example: 8000625942. The Bank or financial institution needed is: Southwest Bank, 1603 LBJ Freeway, Dallas, TX 75234

Card to Card
This is your next cheapest way. If you know someone that has extra money on their card, ask them to help you out.

Your NME® ATM Card™ can receive funds from any other NME® ATM Card™. In order to transfer funds to you, the other cardholder will need your 16-digit card number. The other cardholder can Login to Personal Account, select "Card Transfer" from the menu bar, and follow the simple on-screen instructions. The exact amount to be transferred and destination card number (in this case, your card number) will be required.

Wiredsurf Revamped

This is old news, but I thought I should reiterate how good the news is.

WiredSurf.com has revamped their program and made it very, very enticing for advertisers and surfers. I did a test upgrade a few weeks back and was paid promptly.

It is now 15% for 9 Days, 10 sites to view for 30 seconds each. Phenominal.

Here are the new changes:

1) Upgrades that took place on or after April 21st were transferred into the new system. This means that your account will reflect 15% per day and you will need to surf only nine days.

2) Upgrades that took place before April 21st will continue through the previous system at 8% per day for 16 days. We were unable to include anyone before the 21st, to ensure our system runs smoothly.

3) The Insta-Pay feature has been activated within your members area and you can turn it on or off by entering the "My Account" section of the members site. You are able to turn it on and off multiple times however when your payment goes into the pending stage, whatever you have the Insta-Pay set to will be locked in until your payment has been processed.

The Insta-Pay fees are as follows:

$10.00 - $2000.00 - 4% of your payment total.

$2001.00 -$4000.00 - 5% of your payment total.

$4001.00 - max ($7000.00) - 6% of your payment total.

If you choose the Insta-Pay feature, you will be paid WITHIN 48 hours (two days). If you choose the regular pay option at only 1% fee, you will be paid within five business days.

4) Affiliate commissions are now set to 5% and all current commissions were affected as it was impossible to seperate pending commissions from new ones. We still feel that 5% is very fair and reasonable.

5) E-gold is the option available for payments at this time and even after our debit card program has launched, E-gold will remain an option.

6) You are only required to surf ten sites at this time however we reserve the right to change that limit, or to add a manual surf into the system as a secondary option (not forcing members to use manual however).

7) New banners are being created to display our new percentages and will be available within a couple of days. If you have our banners on your website, please update them as soon as they are available to you.

AlientTrust reporting to the IRS?

AlientTrust, or their new named parent company W3MA, LLC, plans on reporting all payouts to their members to the IRS.

That's fine with me becuase I was going to pay taxes on whatever earnings I make anyway, but some members probably werent going to.

Also, this puts a bunch of peoples personal information in the hands of a company that may run away with it, sell it, use it for illegal activity, who knows.

I am not accusing Alientrust of any of this, but in this crazy industry, who knows? No one, thats who!

You wont be able to get paid after the next cycle of payments until you get "verified" by submitting this information.

This Weeks Cashouts

We've decided in the best interest of all to move forward with this weeks cashouts and not fully implement the new verification system until next week, this gives everyon some additional time to get your stuff submitted, and get re-verified and and documents not received or that are not legible.

I know there has been some concern as to why this is being implemented and I thought I answered that yesterday, but I can again.

There is specific information we need to send to the IRS when you earn more than 600.00 per year. In order to do that we MUST have your SSN or EIN. We have a legal obligation to do that in order to be in compliance with the law.

Over the past couple month's we've all heard and talked about a lot of scams and whatnot, folks if you want tobe part of a legitimate business, you have to comply wit the law. If this industry does fall, the reason will be because of tax issues. The Govt, wants their cut, so we have to give it to them if we wish to stay in business.

As I said yesterday, this information would be necessary anyway in order to process your Virtual Money ATM Card so you would have to give it to us anyway if you wish to remain a member here. We can't order your card without your info - simple as that.

So - send in your stuff as you have time, we'll be adding a new fax number and get some additional printers running later this evening.

As most of you have already noticed we've made some very large changes in the website to make things better and smoother for all.

But before I get into the Updates there is a very important announcement.

ON MARCH 28, BETWEEN 3AM AND 5AM SERVER TIME THE DATABASE WILL BE LOCKED FOR MAINTENANCE.

Our Techs at RackSpace will be installing some database replication so that we can ease the load on the server, and smooth the Ad Viewing and login problems.

YOU CANNOT VIEW ADS DURING THIS TIME SO MAKE ARRANGEMENTS TO VIEW AT A DIFFERENT TIME - THERE WILL BE NO CREDITS ISSUED FOR THIS DOWNTIME.

Ok - now on with the updates.

As many of you have seen already (by the way the fax machine is running out of ink) we've added our Member Agreement and Tax documents into the back office, and it IS mandatory that you send this information in in order to be paid.

We MUST document your earnings for tax purposes and so that we may send out the appropriate documents prior to Jan 30th of 2007. This does not stop you from earnings commissions through viewing ads, or on your affiliate sales, and you may still transfer to your holding account, but we MUST have this information before we can issue a payout through E-Gold moving forward.

This would be mandatory in a few days anyway because this is all information we would need to send out the Virtual Money cards. So - don't panic folks - it's all part of the plan.

Secondly, as you've seen on the Member Agreement form, our LLC. license has come through, and we will begin changing all references of the company from North Shore Media to W3MA, LLC. starting tomorrow.

For those of you NOT in the know - W3MA stands for World Wide Web Marketing Association. We'll begin changing over the support site within the next day or so as well.

We've also solved the issue that many folks raised concerning not being able to view all the ads during a session PRIOR to selecting one for their survey.

Finally, PhoenixSurf programmers were able to implement the fastrack payout script into the system yesterday. The feature allows you to select whether or not you want to be paid within 48 hours. The old 5% fee was amended, now there is a fee structure that goes as follows:

I have been paid by Phoenix Surf, Knights Gold Surf, and Alien Trust. I am waiting for my WiredSurf upgrade to expire. I feel like I need to add one more program to my list.

Why?

Because in this industry and any for that matter, you should always be spread out, so that if you lose in one program, you can still have the others making you something. Plus, the blow will be softened if you have more viable programs in your arsenal.

I am capping my set of important programs at 5.

The last surf site I plan on advertising on is NowDollar. I will post payout as soon as they are paid.

It is fairly new. They pay 8% for 15 days, $10 upgrades. $1000 current max with 3 upgrades at a time. Which means you can be paid very often if spread out you upgrades. One cool feature I haven't seen around, is their Money Page. When this pops up you earn that amount after clicking on the link. They currently have up to a $100 Money Page. They accept Alertpay and E-gold and seem to be big on advertising, offering great deals on banner ads. They will be capping at 20,000 members. They do not have all the hype of the other new programs, but worth a try.

While some “money for nothing” opportunities may be perfectly legitimate, others can turn out to be frauds.
“Auto-surfing” is a form of online advertising that purportedly generates advertising revenue for companies that want to increase traffic to their websites. The premise behind auto-surfing is that companies that advertise on the Internet are willing to pay to increase traffic to their web sites. These companies hire an auto-surf firm or “host,” which in turn pays individual web surfers to view certain websites on an automatically rotating basis. The more sites the individual visits, the more money he or she stands to earn.
While auto-surfing may sound easy and appealing — and risk-free — there can be a hitch. Some auto-surf programs require their surfers to pay to participate, although perhaps not initially. When you first sign up to auto-surf, the firm might assign a limited number of sites for you to visit and pay you accordingly. Once you’ve made a modest amount of money, the firm might encourage — or even require — you to purchase a “membership” so that you can maximize your earnings. The program will promise high — often double or triple digit — returns on your investment in the program, often within days or weeks of joining.
The line you’ll hear is that the more you click, the more you collect. Don't panic yet. There may be a good reason behind all of this. We wont know until EMO Corp. releases some information to the public.

Right when we thought the industry was getting back on its feet. Bammmmmm! According to the Texas Attorney General, EMO pulled a Stormpay. They can not account for $2.4 Million.

This is not good. There were so many people waiting to be verified for weeks on end by EMO. If this turns out to be true and EMO cant answer where the money is, it is going to hurt the industry.

I would not go around signing up for other payment processors anytime soon. ALertpay is the obvious next step, but I would not trus them either.

They have not proved themselves. NO one has except Paypal, and paypal wants nothing to do with this industry, for a reason.

EMO Corp. and officers cannot account for $2.4 million in customer cash
AUSTIN - Texas Attorney General Greg Abbott has obtained an asset freeze and emergency approval for a court-appointed receiver to take over the operations of unlicensed Austin-based online payment service EMO Corp.The company and its officers, Todd L. Tredeau, Tracey Jones and Nancy C. Humphries cannot fully account for more than $5.4 million that consumers placed into their accounts. The company’s books show they have only $3 million cash on hand, which means EMO cannot account for $2.4 million belonging to its customers. The officers failed to register with the Texas Banking Department and obtain a license as a “money services business,” as required by law.

Some say that copying is the best form of flattery. Well, I don't. It's just wrong.
Ever since I put this site up, I have noticed a few copy-cats. It didn't bother me much, but now it does.
For those that don't know, the site used to be called 12dailyprofordummies.com, but I changed the fordummies to 4dummies and eventually to 4newbies. Why, because I was getting a bunch of attention and did not want a cease and desist thrown at me by the For Dummies company. It had been done before.
So, I changed it to 4Newbies and it has stuck since.
Back to why I am annoyed. Like I was saying, there have been a number of copy-cats. By copy-cats I mean, name thieves. Blogging isn't something new, and if someone put a blog together I can't get mad at them for that. But to take the 4Newbies or 4 Dummies name and make a site is just un-original.

Well, I have been thinking about this whole industry, auto surfs, manual surfs, traffic exchanges, call them what you will.

Is this a legitimate way to make a living? I think yes. Can you be hit hard and fall from grace? Yes. You have to know when enough is enough and how much to put into these programs.

Some of them actually provide a chance for people to change their lives? Has mine been changed, a little. But not drastically or to the level I want.

So, back to my dilemma. I want to max out on at least two of the programs I am in. I strongly believe that these are real businesses with real business plans. I think they can make it and will last a while. One has even survived the whole Stormpay/12dp fiasco. The other is relatively new but is in the forefront and run by an excellent group of individuals.

So, do I max out, do I risk my earnings in order to live the life I want for my family? That's the question I am trying to answer.

A part of me wants to take the small earnings I have made and quit, the other part of me wants to keep on with the business and try accomplish some goals.

Well, I just wanted to get that off my chest and will probably add more later.

I am also planning a making a list of resources for due diligence and possibly a list of other blogs I find useful.

Here is an article on the Wall Street Journal regarding surf scams using legitimate businesses to scam people.

On Monday, the Securities and Exchange Commission issued a warning to the public: Beware of "paid autosurf" Web sites.
Such sites, most of them of recent origin, promise to pay investors for viewing a few online advertisements. A "member" goes to the site and clicks on an automatic surfer that visits a series of ads, after which the viewer is rewarded with monetary credit.
There are dozens of such sites, some of which are legitimate businesses. But the SEC said that others, especially those promising to pay members huge profits, can be scams.
Yet the scams wouldn't be possible without the help of larger, well-established Internet businesses, raising the question of whether these companies are -- wittingly or unwittingly -- playing a role in the growing scourge of Internet-based frauds.
Yesterday, for example, at least one suspect autosurf site displayed a "PayPal Verified" logo, meaning users could pay and receive funds using the popular PayPal online payment service owned by eBay Inc. And over on eBay's Internet auction site, sellers were advertising inexpensive software templates that would allow buyers to easily set up their own autosurf sites -- which could be used to scam money out of the unwary.
A PayPal spokeswoman says the Web site in question conforms to its policies, but she adds that PayPal is taking a closer look at autosurf sites in light of the SEC's warning. An eBay spokesman says that the company is reviewing the autosurf postings but adds that eBay likely would take no action if the software also has legitimate uses.
The SEC warning was prompted by the recent collapse of one of the biggest paid autosurf sites, 12DailyPro.com, which promised members a 44% profit in just 12 days -- a return that the SEC said amounted to more than 1,300% annually. Members could join 12DailyPro at no charge but got paid only if they "upgraded" to a paid membership and signed on to view ads 12 days in a row. Some investors put in as much as $6,000 every 12 days.
The agency last week moved to freeze funds controlled by the Charlotte, N.C., company that operated 12DailyPro, saying it had defrauded more than 300,000 people of more than $50 million. The agency said 12DailyPro claimed it generated revenue in part from advertisers willing to pay its members to view their online ads. In reality, the SEC charged, at least 95% of revenue came from fees paid by other members, making the site "almost a pure Ponzi scheme."
Named for Charles Ponzi, an Italian immigrant to the U.S. who gained notoriety early in the 20th century, a Ponzi scheme promises huge returns to investors but pays them with money from subsequent investors rather than from revenue generated by business. "Paid autosurf programs have become an enormous industry on the Internet," Randall R. Lee, the head of the SEC's Pacific region, said in a statement. "When these schemes depend on attracting new members in order to pay returns to current members, they are destined to collapse."
Charis Johnson, who operated 12DailyPro, previously has defended the site as legitimate but last week agreed to the SEC's asset-freeze proposal without admitting or denying the allegations. The SEC charged that Ms. Johnson transferred $1.9 million to her personal bank account since mid-2005. Ms. Johnson's attorney, Noell Tin, yesterday said he and his client are looking forward to the SEC process, which he said would lead to money being returned to members and declined to comment further.
A key part of 12DailyPro's operation relied on a small PayPal rival, StormPay Inc. of Clarksville, Tenn. Payments to and from the Web site were made via StormPay and a couple of other small online payment processors.
StormPay officials didn't return calls seeking comment. The company has previously said it voluntarily froze funds related to 12DailyPro about a month ago after being alerted that the Web site may have been part of a fraud. Although the SEC said the amount originally frozen was about $50 million, with additional sums already having been paid out to members, the total involved in the alleged scheme likely was significantly greater.
Instead of being angry with 12DailyPro, many investors in the site have turned their ire on StormPay. "They basically just froze my money, that I felt I was entitled to," says Mike Bromell, of Austin, Texas, who started investing in 12DailyPro in December. "It's just like if I wired you money via Western Union, and Western Union decided to keep it."
PayPal, the dominant force in the online-payment industry, says under its "acceptable use policy" it won't do business with illegal pyramid schemes and "Get Rich Quick" schemes "where the claims of profit or returns on investment are unrealistic or unsupported." It also bans transactions related to online pornography and several years ago stopped doing business with online gambling sites, after reaching a settlement with New York Attorney General Eliot Spitzer.
But PayPal is listed as a payment-processing option on a number of autosurf sites. One, NetInvestAutoSurf.com, promises "members" a return of 1% per day on fees they give the site, and displays a yellow "PayPal Verified" logo. Another, 123eTraffic.com, says on its home page: "Get paid up to $3,100 Monthly -- no selling, no marketing, just surfing! 123eTraffic has to be the fastest, easiest way to make money on the Internet." Email messages directed yesterday to the operators of both sites went unanswered.
Amanda Pires, a PayPal spokeswoman, says both Web sites are "within the bounds of our policies." Ms. Pires says the sites don't have characteristics of typical pyramid schemes -- they allow free membership, and members don't make most of their money by referring other members to the site. As for the "PayPay Verified" logo, Ms. Pires says it "means not much," except that PayPal has confirmed that the customer is linked to a real bank account.
Still, she says, these are "a new type of business we are just starting to see on the Web. We are monitoring these businesses very closely to ensure there are no violations with our existing policies, and to ensure there are no issues reported to us by our customers."
Robert L. FitzPatrick, who wrote a book about pyramid schemes, "False Profits," reviewed several autosurf Web sites accepted by PayPal and says they are "thinly disguised Ponzi schemes." PayPal, he adds, is "trying to narrowly define a pyramid scheme because PayPal makes money every time there is a transaction."
Tucker Ronzetti, a Coral Gables, Fla., attorney who has represented investors in class-action suits related to Ponzi schemes, says third parties, such as payment processors, could be held liable under state laws for "aiding and abetting" an Internet fraud. But, he says, such cases are rare and difficult to prove, because the third party must have "actual knowledge" of the fraud.
"On the one hand," he says, "you've got to applaud PayPal for trying to monitor this. It's a legitimate problem, and innocent people are being victimized. On the other hand, if they're looking at the definition of a pyramid or Ponzi scheme in too strict or picayune a fashion, they may be allowing these schemes to flourish."
Many sites similar to 12DailyPro continue to operate. They come and go: One Web site offering advice about online investment programs lists more than 2,200 sites that have become defunct. One reason for the proliferation of copycat sites may be the easy-to-use software templates, or "scripts," that allow anybody to instantly set up an autosurf Web site with built-in links to online payment processors.
Hani Durzy, an eBay spokesman, says the company prohibits the sale of products directly related to fraud. But he notes that the SEC itself said that autosurf programs can be legitimate, and unless the software templates specifically are marketed as allowing Ponzi schemes or the like, eBay probably would allow them.

Well, I am back from taking care of some things. This weekend felt like an eternity. Almost feel lost. Had about 300 emails waiting for me.
Checking my mail left me a bit confused. I see that NME has a new site being built, a pixel site is going to be launched as well. I cant wait to see what thats about, the pixel craze has been exhausted to almost nauseating points.
Also, Phoenix surf indeed became a manual surf.
Another thing, Charis seems to have a personal vendetta against any surf programs that have arisen or lasted after 12daily pro's departure. Like you said,let it go.
She has posted new info on her plans, but again, they are vague. Check them on her blog.
12daily pro site is down. Probably because the SEC is "taking care of things."
Some sites are changing their terms and models, but lets hope that things will not get turned upside down.

To those watching for a comment from me on the 12dp forum regarding today's SEC press release and the cooresponding filing, there will be none there.The website is to now be under the control of the SEC and thus I am unable to post anything on the site without approval.I hope to have my attorneys agree to the release of a statement within the next day or so which will clarify our position, dispel the inaccuracies in the filing and explain why we reached an agreement with the SEC that was in the best interest of members, despite such inaccuracies.Keep in mind that the SEC never interviewed us, never talked with us, never examined our data, never looked at our bank accounts, and never examined our books before placing this filing. Government Action Against 12daily pro

In a recent newscast, ABC4 News' Brent Hunsaker, reported that 12 Daily Pro now has a cease and desist order against them.

What does this mean? It could possibly be the end of 12dp.

I doubt it though. Why? According to the news 12dp is being told to "cease the sale of unregistered securities by unlicensed individuals".

I do not think that Charis ever tried to make 12dp seem like an investment. Members were purchasing advertsing.

I sincerely hope to hear some good news on Monday. It will potentially be the day that we can all breathe a sigh of relief.

Well, looks like the fine folks at PhoenixSurf.com are at it again. They have extended the time that a Free member account is deleted due to non upgrade from 7 to 30 days. Why? Becuase many new members, OVER 3000 ALREADY!!!!!!, are having issues setting up accounts and funding with e-gold.

There will alledgely be a new update on the 12dp issue posted by Charis on Monday, two long days away, well not that long. Now that we have Phoenix Surf to advertise on, its okay.

Like most of her legal posts, this one was just as vague. Here is her news regarding the Monday news release. Refunds may begin, I wonder if emo will be the way to get paid, if so I am covered. I still have my stomrpay account open too, just in case.

Keep in mind this was taken from a forum, which has high standards and does not allow slander or any malicious post what so ever towards any one.

I sure hope that we can all get thorugh this. I for one will continue to advertise on 12dp when it reopens.

"Please be aware that Monday, 12dp will release a statement regarding a compromise that has been reached between 12dp with authorities that will lead to the resolution of this matter and the beginngings of an accounting and refund process.

You may hear news this weekend regarding a legal pleading that contains much misleading information provided to authorities primarily by StormPay. Our attorneys have already proven to the authorities the most outstanding allegation made to be false, which likely will not be reported on the news. One issue to be cleared up is the fact that StormPay does not have an option for creating merchant accounts and linked merchant bank accounts. If any business signs up for a StormPay account, they have to use someone's individual name and StormPay insists that any bank account added must match that same individual name.

But a full statement addressing such issues will be made to that affect early next week.

Thank you for your patience and we are glad that we have been able to take steps that will help bring this ordeal to a close soon."

GPT PREDICTION CAME TRUE - SADLY!!

Well, it came true. On Sunday I predicted the GPT convention would be cancelled by Charis due to legal reasons. The OFFICIAL news came in today via the 12dp member main page. While most were saying the the convention would go on, I was bold enough to stand by my own research.

Bold Prediction regarding 12dp!!!!

Your read it here first folks! I am about to make a bold prediction regarding the first annual GPT Convention. Are you ready?

I predict that next weeks convention is not going to happen. I seriously want it to go on, but dont feel that it will.

This prediction comes after I contacted the convention host and received confirmation of NO cancellation.

If Charis, the organzier of the event, wont even keep us more informed with whats going on with 12dp then what makes you think she is going to hold this event. It's been a 2days 10hrs ago since her latest news update on 12dp.
She will probably state that due to the legal battle that is ongoing with stormpay, her lawyers have advised her to postpone the event until it will not jeopordize their case, or something like that.
Factor in the investogations and the subpoenas and its a recipe for NO convention. I dont think much will get done in the first place. There are going to be tons of individuals trying to get answers for what occurred a few weeks ago. She cant talk about that, remember? Her lawyers advised postponing the launch of the new site due to the case (new site seemed like an advertising/design business model, but I may be wrong). A convention about autosurfing and the getting paid-to industry, common!!

Subpoenas issued to 12DP and Stormpay

The latest in the Stormpay/12dailypro saga "12DailyPro of Our Lives" is that subpoenas have been issued to stormpay and 12dp commanding them to appear in the state, according to ABC4's Brent Hunsaker.

I cant wait to see how the Convention goes next week.

The FBI in North Carolina is now leading the investigation of Charis Johnson and 12 Daily Pro.

The Special Agent in Charge is asking for information and victim stories. Reports can be submitted in two ways: 1) calling this toll free number 1-800-876-7060 or, 2) fill out a form on the Internet. The website is www.ic3.gov.

Agents have gotten a head start from the Charlotte Better Business Bureau. Tom Bartholomy, BBB President, has handed them his complaint files.

Then again, FBI agents may simply want to be at the Airport Embassy Suites in Charlotte next weekend. A reported 500 12 Daily Pro members are holding a 3-day convention there. Charis herself is expected to be the headliner. According to sources that have seen the itinerary, she promises to conduct a Question and Answer session. Despite the troubles of the past couple weeks, hotel managers confirmed the convention is still on.

Meanwhile, the BBB in Nashville, Tennessee rolled out a new report on Storm Pay, the online payment service that froze the 12 Daily Pro account, precipitating this mess. The report is not flattering, highlighting a history of unresolved complaints. With the consent of the people who submitted complaints, the BBB of Middle Tennessee has also shared its information with the FBI’s resident agent in Nashville.

One other thing: When ABC 4 talked with Storm Pay executives on Monday, they claimed that 12 Daily Pro was just a small portion of their overall business; 3 to 10 percent, they said. But a graphic from Alexa.com of web traffic for the two companies seems to indicate a different story. The tracks are almost identical. Both rise sharply through January, and then plummet in February. It would appear that Storm Pay’s fate is more closely tied to 12 Daily Pro than its executives care to admit.

Meanwhile back in Utah, the state division of consumer protection has issued four subpoenas, three to 12 daily pro, and one to Storm Pay. The state is asking all those subpoenaed to come to Salt Lake City, because the state now wants to get their testimony on the record.

The subpoenas began going out several days ago, and one was issued just Friday afternoon.

According to the state's top consumer watchdog, it's time to find out how many Utah "victims" are involved.

As to how many Utahns are involved in 12 Daily Pro and Storm Pay, Francine Giani, of Utah's Commerce Department suggested, "Hundreds? Hopefully not thousands, but it could be thousands easily, but we don't know that information. That's what we're hoping the subpoenas will uncover."

The subpoenas "command" the companies and individuals to appear in Utah for depositions. If they don't comply, the subpoenas warn they may be considered in contempt and referred to court.

These are tough measures, Giani admits, because according to the state, "It looks like a pyramid, its acting like a pyramid, its smelling like a pyramid scheme." Giani also added, "It's a corny thing, but if it sounds to good to be true it probably is. I think we need to think before we send in our money."

Giani says so far, there have been lots of phone calls but only one official complaint in Utah, She also added that if more people file paperwork with the state, that could help the two other states which now have official investigations underway.

The Utah State Division of Consumer Protection has also asked ABC 4 to remind Utahns of where to find its online complaint form.

It's just like I assumed. I had a feeling that something was fishy about that joint statement that Charis posted. So, she confrims that Stormpay is being very treacherous and that, yet again, they are not responding to their lawyers. Now, as of Monday, they have been contacted by stormpay. I do not believe that anyone will get their money back, if they do it will be no where what they deserve to get.

I want to take a moment to shed some light and truth on some recent developments in our StormPay matter. Much has been said and much needs to be clarified. I hope the following update can help toward that end. Beyond StormPay’s displeasure with our using another payment processor, at no time in our relationship with StormPay did they express they had any issue with our business, with our transactions, or with the large fees they were earnings from our transactions. To the contrary, even in the midst of their demands that we remove our other payment processor, StormPay insured us that we had always been a very good client and that they had done much and wanted to continue to do much to help our business. StormPay has also placed on its website claims and information on its website that are false and misleading. They also are making decisions regarding our account and the accounts of our members based on their own opinions and assessments or our company made without any supporting facts or documentation. They provided a description of the way they perceive all autosurfs function. Their description does not take into account the unique terms of 12daily Pro nor internal factors about our company operations which they are not privy to. StormPay, throughout this process of our attempts to regain access to our account, has refused to communicate or cooperate. They drafted last week’s joint statement and instructed us to post it under the guise that they would work with us to refund our members. During that very conversation during which that joint statement was agreed upon, StormPay unilaterally conducted chargebacks of its users accounts and began withdrawing monies from users bank accounts and credit cards. With no access to our account, there was no way we could stop their unwarranted actions nor determine exactly what actions were taken. Please understand that ALL 12daily Pro funds being held by StormPay were funds intended for the payment of withdrawals for both StormPay users, and EMO users, and all members transitioning to both processors from E-Gold. It was our attempt to move those funds that StormPay began these unwarranted actions that have led us to this point. The matter was further complicated because some of the money charged back to our account by StormPay included paid referral commissions that were derived from upgrades purchased with payment processors other than StormPay. The more they do, the more of an accounting nightmare it will be if and when we are able to get access to our account and/or funds. Regarding the joint statement that was issued, we want to make it clear that we participated in its drafting only because we were assured StormPay would work with us on a refund strategy. From that point StormPay ceased all communication with us and did not honor their agreement to do so, nor did they respond to a specific demand letter issued to them by our attorney. This past Monday, StormPay finally contacted us. Again our demands were clearly issued. We await their timely response, if they are to avoid a legal action which we are fully prepared to initiate. We have learned that the FBI is actively gathering information regarding the alleged unauthorized debiting of StormPay user accounts, bank accounts and credit cards. We also are very hopeful that government officials may be able to assist us in the recovery of funds so that they may be properly dispersed. We are all in this together and we will keep you up to date as we know more.

Alientust.com owners have posted new news. Apparently they plan on switching their business model around, DRASTICALLY. I need more clarification, but it seems like you will only make 35% of your upgrade (now called ad spend) back. From the looks of it, you need to refer people in order to make real money, because you will get 35% of your referrals upgrade.
They might lose a lot of business. Atleast the plan of saving 20% of the upgrade for a stormpay fund to pay back victims.

Good Afternoon Everyone,First of all let me apologize for not updating everyone over the past few days. All of us were out of town scouting convention space for the pending convention in November. We looked at some promising locations but nothing concrete as of yet.What I'd like to do today is talk a little bit about the StormPay issue and our plan moving forward to help correct some of the mistakes being made in the industry and what we're going to do to help legitimize the business model.Our attorney has advised us to do 3 things, number 1 contact all the federal agencies we can and file complaints about StormPay to ensure that we are part of the group doing likewise, and ask for a review of our company to ensure that we are indeed doing business legally, that process has already begun.2nd, to retain legal council in the state of Tennessee to assist with the expedition of our case against them.And number 3, watch and see what happens in the larger cases. Since 12DP is heavily involved with the legal aspect of the case taking a wait and see approach in regards to their case seems very logical and will give us a good foundation to build our case.I will not make any further comments about the status of our legal involvement because this would simply undermine our chances of a successful outcome. If you think for one second that StormPay doesn't have people reading these posts here and at all the other forums across the net you're crazy. We're not going to give away our strategy, and that's all I can say.The future of the AS industry.The 5 of us, Stephanie, Brian, Jenny, Melissa and myself spent a good deal of time this weekend discussing what has happened, what will happen and if there's anything we can do to change it, and we believe we can. There are however some undeniable truths that we all need to accept if we want the industry to survive.The AutoSurf as we knew it before is over, period. There's simply no way that we can recover the momentum, or boost the confidence enough to get back to where the industry was just a few short weeks ago. The days of 40% payouts are gone. No owner in their right mind would go back to that knowing what we know now, and seeing what has happened. No matter how hard you try to insulate yourself, you are always going to be at the mercy of whoever is running the payment system. Ultimately we can still surf for cash, BUT there needs to be a realistic system in place that can be supported long term, there needs to be a real cost for the product delivered, and the company needs to make a profit in order to stay in business. In the old business model, the majority of your earnings were predicated on simply paying you your own money back. I never really liked that system to be honest, I think it's silly that I have to surf for 10 days or whatever just to get my own money back. But the old system didn't rely heavily on commissions, they were more of an afterthought. Let's look at the reality of that scenario.On each sale the company is upside down by the amount of the plan ie: 40%, 20% or whatever, the cost of commissions, in our case it was 5%, and the cost of processing payments, which is substantial. In a normal week at SP we paid nearly 300,000 in fees.I don't care where the owner is investing, or what they are doing outside the auto-surf to make money, there's simply no way to create that type of return for the average AS business. This is the reason so many of them fail. Our model was always different from the very beginning, and allowing everyone to cashout every week and decide how much they wanted allowed us to have substantial reserves, usually more than what was paid out. So there's no way we would've collapsed in the short term, but looking long term, the business model simply doesn't stand up, UNLESS you diversify BIG TIME.So in looking at a way to allow folks to earn a living by surfing we needed to make a commitment to keeping the system WITHIN the means of each individual sale. To ensure that we are legal, and ensure we are within the boundaries of reality, we decided to create a business model that would have long term staying power, and be easy for other owners to implement as well without the need to have 20 programs running in order to support the autosurf business.Folks the industry is dying - we need to change the model. We will either lead the way, or fall by the wayside.As any business professional will tell you there is always a cost of doing business. You have to pay for tools you need to build a business and/or income. In the old ASC model there was no cost for your advertising. You got everything for free and then some. We need to get back to reality and get back to understanding that you build an income based on referring, not on surfing.Referrals are what fuel EVERY company on earth. Freestanding brick and mortar businesses, MLM business, Affiliate programs like Amazon, and so on. Even movies are referral based, you read a review in the paper, or your Aunt Sally says hey so and so was great go check it out.This IS the way businesses are built. You don't see any of these businesses giving away more money than they take in do you? Then why are we? This is the reason StormPay and others are screaming Ponzi. Whether the model is or not, is still open for debate, but we're creating a model that will not be included in that discussion.There will be a real cost for each ad pack you purchase, you will be able to re-coup a good percentage of that advertising in the form of a rebate for viewing the ads of other members, and you will earn explosive commissions because now we can pay commissions based on the sale made because the amount earned surfing is within the realm of reason.Here's how it will be set up at the beginning, and then the numbers will change accordingly once some of our obligations are met.Members who choose to purchase ad Ad Buy will earn 4.9% daily for 7 days. This equates to 35% of your Ad Buy. You will receive 35% commissions on Ad Buys purchased by your personally sponsored teammates. The company will retain 10%, and the remaining 20% will be allocated to the repayment fund to help repay all the members who were damaged by StormPay. Any and all funds retrieved through litigation will be allocated to this fund as well.Now I know folks that this is in no way as lucrative as what the industry was doing before, BUT, it is stable, smart, and can be sustained forever. No one is in over their head and everyone is getting paid according to what they produce, not what they have to through into the kitty.Folks the industry CAN survive and there can be a ton of great ASC sites on the net again, but the model HAS TO CHANGE!! We can no longer sit idly by as more and more scams come along and rob us of our money. This plan is THE plan that can help save the industry.Just as a note, the plan numbers will change once all funds are repaid to members, to 40%,40% and 20% for the company. We also plan on instituting bonuses and contests to be named later on, and there can be a wealth of other things added to the mix to really take this to the next level, but let's start here and see where it goes.We're going to be having a live conference tonight and as soon as I get the room ready I'll post the link here.I know many of you may decide to continue to work the high risk stuff, and may leave us, and that's fine, you have to do what's best for you. By the same token we must do what's best for us and the industry as a whole. As the number 2 site on the net we feel an obligation to create something that looks to the future and helps get the smaller ASC sites back in the game, big or small EVERY site out there is important, and as an industry we really need each other. So for those of you who are only interested in making a quick buck and running for the door, you'll need to look elsewhere. We're building a system that will last for many years to come and will be outside of the scrutiny of government regulation. Granted we may not take in the millions that we did before right away, but this program will be much more successful over the long haul because there is no outside funding required to make it work. Everything is paid for with the sales generated by the system itself, and isn't long term stability REALLY what we're all after?I hope to see you all on the conference tonight.
